Les Voies d'Exécution des Décisions de Justice.

Au terme de toute procédure une décision est rendue, parfois après que diverses voies de recours auraient été épuisées. Lorsqu’une transaction intervient entre les parties au cours d’un litige, un protocole d’accord sanctionnant la transaction est signée par les parties, qui équivaut à une décision de justice.

L’exécution des décisions de justice est une étape très importante. Rien ne sert d’obtenir une décision que l’on ne peut exécuter. De même les sentences arbitrales se doivent d’être exécutées. L’étude des moyens pour exécuter les décisions de justice est d’une importance particulière. Le législateur a prévu des multiples voies pour exécuter les décisions.

Les voies d’exécution sont examinées à travers l’analyse des principes généraux qui les régissent, l’étude de principales d’entre elles et la distribution du prix de vente des biens saisis entre différents créanciers.
